 PART II THE ESTIMATES OF REVENUE AND EXPENDITURE, AND APPROPRIA- 
TION
  
  nnual estimates
  The Financial Secretary shall cause to be prepared in each 
financial
  estimates of the revenue and expenditure of the Government for 
the
  following financial year, and shall cause such estimates to be 
laid
  re the Legislative Council before or as soon as practicable after 
the
  encement of the financial year to which they relate.
  Subject to subsection (3), the estimates of revenue and 
expenditure
  l be in such form as the Financial Secretary may from time to 
time
  ct.
  The estimates of expenditure shall--
  classify expenditure under heads and subheads with the ambit of 
each
  described;
  in respect of each head show the estimated total 
expenditure, the
  ision sought in respect of each subhead, the establishment of
posts
  any), and the limit (if any) to the commitments which may be 
entered
  in respect of expenditure which is not annually recurrent; and
  specify the controlling officer designated in respect of each
head and

  Where there is a requirement under any enactment that 
expenditure be

  pproval of estimates of expenditure and appropriation
  The heads contained in the estimates of expenditure for a 
financial
  shall be included in an Appropriation Bill which shall be

  Upon the enactment of the Appropriation Ordinance the 
estimates of
  nditure for the financial year to which the Ordinance relates
shall be
  ed to be approved to the extent that they are provided for in

  nance and shall have effect from the first day of such financial
year.
  Expenditure for the financial year on the services of the 
Government
  l, subject to this Ordinance, be arranged in accordance with the
heads
  subheads and be limited by the provision in each subhead shown
in the
  mates of expenditure as approved or as may subsequently be 
changed
  time to time in accordance with section 8.
  uthorization of expenditure in advance of appropriation
  The Legislative Council may, in advance of an Appropriation
Ordinance,
  esolution authorize expenditure for the services of the
Government in
  ect of a financial year to be charged on the general 
revenue, in
  rdance with this Ordinance and subject to such 
limitations and
  itions as may be specified in the resolution.
  Expenditure charged on the general revenue pursuant to a 
resolution
  r this section shall be arranged in accordance with the 
heads and
  eads shown in the estimates of expenditure laid under section 
5 and
  provisions of this Ordinance shall, for the purposes 
of this
  ection and subject to such conditions and limitations as 
may be
  ified in the resolution, apply to such estimates as though they 
were
  approved estimates of expenditure.
  Expenditure charged on the general revenue pursuant to a 
resolution
  r this section shall be set off against the amounts 
respectively
  ided in the Appropriation Ordinance upon the same

  Subject to this section, no changes shall be made to the 
approved
  mates of expenditure except with the approval of the Finance
Committee
  a proposal of the Financial Secretary.
  Without limiting the generality of subsection (1) such 
changes may
  ide for all or any of the following matters--
  the creation of new heads or subheads;
  supplementary provision in approved or new subheads;
  variations in the establishments of posts;
  increases in the limit to the commitments which may be entered
into in
  ect of expenditure which is not annually recurrent.
  The Finance Committee may delegate to the Financial 
Secretary the
  r to approve changes subject to such conditions, 
exceptions and
  tations as are specified in the delegation.
  The Financial Secretary, where a delegation by the Finance 
Committee
  r subsection (3) so provides, and subject to such 
conditions,
  ptions and limitations as are specified in the delegation, may
further
  gate his power to approve changes to any public officer.
  A delegation to any public officer under subsection (4) 
shall be
  ect to such further conditions, exceptions and limitations 
as the
  ncial Secretary may specify.
  Nothing in subsection (1) shall be construed as 
limiting  or
  cting--
  the power of the Governor to make any proposal, or allow or direct
any
  osal to be made, to the Legislative Council, the object or effect 
of
  h is to require a change to the approved estimates of expenditure;
or
  a requirement under any enactment that expenditure be met 
from the
  ral revenue.
  The Financial Secretary shall cause such changes to be made 
to the
  oved estimates of expenditure as are necessary in respect of any--
  approval given under subsection (1), (3) or (4);
  expenditure pursuant to a proposal referred to in subsection (6) 
(a);
  
  requirement referred to in subsection (6) (b) not otherwise 
provided
  by approval under this section.
  The Financial Secretary shall at the end of each quarter 
of the
  ncial year or as soon as practicable thereafter--
  report to the Finance Committee changes made to the approved
estimates
  xpenditure in that quarter upon approval by him or by any 
public
  cer pursuant to a delegation under section (3) or (4), as the case
may
  and
  table in the Legislative Council a summary of all changes made
to the
  oved estimates of expenditure in that quarter under this section.
  Without prejudice to section 9, expenditure in respect of 
which a
  ge to the approved estimates is made under this section

  ged on the general revenue notwithstanding that there has 
been no
  opriation in respect thereof by an Appropriation Ordinance.

found that

 PART III CONTROL AND MANAGEMENT
  
  General powers and duties of the Financial Secretary
  Financial Secretary shall, subject to this Ordinance and any 
other
  tment, have the management of the finances of the Government and 
the
  rvision, control and direction of all matters relating 
to the
  ncial affairs of the Government.
  Power to make regulations and give directions, etc.
  Without prejudice to any other provision of this 
Ordinance, the
  ncial Secretary may make such administrative regulations and give
such
  nistrative directions and instructions not inconsistent 
with this
  nance as may appear to him to be necessary or expedient for the
better
  ying out of the provisions and purposes of this Ordinance and for 
the
  ty, economy and advantage of public moneys and Government
property.
  Any regulations made or directions and instructions given 
by the
  rnor or by any person authorized by him, for purposes similar to
those
  espect of which regulations, directions and instructions may be 
made
  iven under subsection (1), and which are in force at the 
commencement
  his Ordinance, shall, in so far as they are not inconsistent with
this
  nance, remain in force and shall be deemed for all purposes to 
have
  made or given under this section and to be liable to revocation 
or
  dment hereunder.
  Controlling officers
  Estimates of expenditure laid before the Legislative Council 
shall
  gnate a controlling officer in respect of each head and subhead.
  Subject to section 14 (5), a controlling officer shall be 
responsible
  accountable for all expenditure from any head or subhead for which 
he
  he controlling officer, and for all public moneys and 
Government
  erty in respect of the department or service for 
which he is
  onsible.
  Controlling officers to obey regulations and directions, etc.
  y controlling officer shall obey all regulations made and 
directions
  nstructions given by the Financial Secretary under section 
11 and
  l, if so required, account to the Financial Secretary 
for the
  ormance of his duties as controlling officer.
  Authority of controlling officers to incur expenditure
  Subject to any regulations made or directions or instructions
given by
  Financial Secretary under section 11 and to any reservation 
made by
  Financial Secretary under subsection (3), a controlling officer 
may,
  accordance with this Ordinance, incur expenditure and 
authorize
  nditure to be incurred against any provision shown in any subhead 
for
  h he is the controlling officer.
  No expenditure shall be incurred against any provision shown 
in any
  ead except by or under the authority of the controlling officer.
  The Financial Secretary may, in writing, reserve the whole or any
part
  ny provision shown in any subhead and for so long as such 
reservation
  ins in force no expenditure shall be incurred against the 
provision
  rved.
  A controlling officer may, in respect of any subhead for which 
he is
  controlling officer, by allocation warrant signed by him or 
by a
  ic officer authorized generally or specially by him, 
authorize any
  r controlling officer to incur expenditure or authorize
expenditure to
  ncurred against any provision shown in that subhead--(Added 8 of
1984
  )
  for any purpose within the ambit of that subhead; and
  in accordance with the terms of the allocation warrant.
  The controlling officer to whom an allocation warrant is issued 
under
  ection (4) shall be responsible and accountable for any 
expenditure
  rred under the warrant as if he were the controlling 
officer
  gnated in respect thereof under section 12.
  
  Further authority of controlling officers in respect 
of urgent
  nditure
  where an urgent need has arisen for expenditure to be incurred
which--
  requires a change to the approved estimates of expenditure in 
respect
  atters referred to in section 8 (2) (b) or (d); and
  in the opinion of a controlling officer cannot be deferred until 
the
  ssary change is made in accordance with section 8 without 
serious
  iment to the public interest, the controlling officer may, 
on his
  onal responsibility, incur the expenditure in anticipation 
of such
  ge.
  As soon as practicable after incurring expenditure under
subsection
  the controlling officer shall report the matter to the 
Financial
  etary for the purpose of having the necessary change made 
to the
  oved estimates of expenditure.
  Where the necessary change to the approved estimates of
expenditure is
  made in accordance with section 8, the expenditure incurred shall 
not
  charged on the general revenue but shall remain the 
personal
  onsibility of the controlling officer who incurred the 
expenditure.
 PART IV RECEIPT, PAYMENT AND CUSTODY OF PUBLIC MONEYS
  
  Duties of Director of Accounting Services
  The Director of Accounting Services shall be responsible 
for the
  ilation and supervision of the accounts of the Government, 
for the
  gement of accounting operations and procedures, and for ensuring 
that
  regulations directions or instructions made or given 
under this
  nance relating thereto and in respect of the safe custody of 
public
  ys and its accounting are complied with.
  Without prejudice to the generality of his duties under
subsection (1)
  the powers conferred on the Financial Secretary by section 
11 the
  ctor of Accounting Services shall--
  ensure that adequate arrangements are made for bringing 
promptly and
  erly to account all public moneys received and paid by the
Government;
  pay such sums from public moneys as he is authorized to pay under
this
  nance or any other enactment;
  ensure, in so far as is practicable, that adequate 
arrangements are
  for the safe custody of public moneys; and
  bring to the notice of the Financial Secretary and the 
Director of
  t, in writing, any material defect in departmental control of
revenue,
  nditure, cash, stamps, securities, stores and other 
Government
  erty which may come to his notice and any persistent 
breaches of
  lations, directions or instructions made or given 
under  this
  nance.
  Subject to the provisions of any enactment, in the exercise 
of his
  es the Director of Accounting Services shall be entitled to 
inspect
  offices and shall have access to all records, books, 
vouchers

浅析场地出租人的商标侵权责任

不久前,北京市新秀水市场的所有人因被怀疑销售假冒商品而被5家世界知名品牌公司告上法庭,这不仅是新秀水市场也是市场行业内首家因此成为被告的场地出租人 。该案的最终判决将会对打击商标侵权活动和场地出租人的经营活动产生巨大影响。鉴于我国现行法律并没有对此种情况是否属于侵权做出明确规定,笔者针对本案中涉及的法律焦点谈一下自己的观点,以供同行参考。
(一) 案情简介及争议法律焦点
今年4月,中国外商投资企业协会优质品牌行业工作小组委托的调查员由中国公证人员陪同从新秀水市场19个正在销售假冒该行业工作小组成员品牌商品的摊位公证购买了侵权样品。5月,律师函送达新秀水市场的所有人北京秀水豪森服装有限公司(简称“秀水豪森”)。6月,调查组确认假冒销售行为仍在继续。7月,再次公证购买了侵权样品。在警告无效的情况下,行业工作小组成员遂决定对秀水豪森和售假的5家商户提起诉讼。
原告中国外商投资企业协会优质品牌保护委员会行业工作小组(以下简称原告)认为,根据中国法律相关规定,市场管理者有监管市场,禁止销售侵权产品的义务。中国商标法实施条例还规定,故意为商标侵权提供“设施”或者其他“便利条件”的,应承担商标侵权责任,这应该包括为销售、存放假冒他人品牌商品而提供场地的行为。故请求法院判令被告立即停止侵权行为,并赔偿损失。原告希望通过诉讼,明确场地出租人的商标责任。
(二) 场地出租人能否被视为销售者
场地出租人与场地承租者之间系场地租赁关系,那么,如果场地承租者销售了假冒他人商标的商品,场地出租人能否被视为销售者?根据我国现行商标法及相关司法解释,销售者有义务对其销售产品的进货渠道、所售商品的合法性进行审查,如果不能提供产品的合法来源并说明提供者的,则视为主观上有过错,需要承担赔偿责任。但如果场地出租人不被视为销售者的话,那么在缺乏法律和合同约定的情况下,场地出租人就没有权利和义务审查场地承租方在所承租场地内销售的产品来源。可见,主体的性质决定了其是否应承担法定审查义务,进而对最终认定是否侵权具有十分关键的意义。
笔者认为,“场地出租人”与“销售者”是两个不同性质的概念。“场地出租人”以出租、物业管理等为其经营主业,不包括批发、零售商品。对于一般消费者来说,其也不具有公示意义的销售者身份。目前,各地许多小商品批发市场、服装批发市场都是由场地管理公司将场地租赁给场内商贩进行经营,直接销售产品的是承租场地的商贩,管理公司的地位像“房东”(landlord)。本案中,被告作为新秀水市场的管理者,其职责是对市场进行管理(类似于物业公司),因此应被视为“场地出租人”而非“销售者”。实际上,我国已有司法判例对这个问题给出了答案,不承认场地出租人是销售者。
(三)场地出租人是否应承担侵权责任
关于场地出租人的商标侵权责任,我国现有法律并没有明确规定,与此相关的只有商标法实施条例第五十条。该条规定:“有下列行为之一的,属于商标法第五十二条第(五)项所称侵犯注册商标专用权的行为:┉(二)故意为侵犯他人注册商标专用权行为提供仓储、运输、邮寄、隐匿等便利条件的。”由此可以看出,该款要求必须具备两个条件才构成侵权。一是主观上要求“故意”,二是客观上有提供“仓储、运输、邮寄、隐匿”等便利条件的行为。如果将该款适用于场地出租人,必须先明确两个问题。一是“故意”的认定标准如何确定?既然场地出租人并不直接销售商品,也没有法定义务对场地承租人的销售商品进行审查,那么,在何种情况下才能认定其主观上构成“故意”?二是“等便利条件”是否还包括“仓储、运输、邮寄、隐匿”四种情况外的其他情况?因为出租场地的行为明显不属于 “仓储、运输、邮寄、隐匿”中的任何一种。
(四)美国对场地出租人的责任承担的态度
鉴于国内法律规定没有明确规定场地出租人侵权责任,我们可以借鉴国外有关司法实践来加深有关理论研究。
美国联邦商标法——《兰哈姆法》对场地出租人(landlord)的责任没有明确规定,司法实践中是借用普通法上的“辅助侵权”理论(contributory infringement)来判定场地出租人应承担的商标侵权责任。
将“辅助侵权”理论适用于商标侵权案的第一个判决是Inwood Laboratories v. Ives Laboratories案(以下简称“Inwood”案) 。该案中的被告向一个药剂师销售药品,且明知药剂师将从其处购得的药品标上另一种商标而使用。法院认定如果满足以下条件,被告构成商标的辅助侵权:(1)故意引诱他人侵犯商标;或者(2)明知产品需求者将产品用于商标侵权活动仍向其提供产品。
如果说Inwood案并没有提到辅助侵权理论如何适用于场地出租人的话,在随后的Hard Rock Café案中 ,联邦第七巡回上诉法院将辅助侵权理论适用到了场地出租人——跳蚤市场(flea market)的经营者。在该案中,法院认定,如果跳蚤市场的经营者对在其市场上不断发生的侵权活动“熟视无睹”,那么就要承担商标的辅助侵权责任。审理该案的法院认为,如果被告“知道或应当知道他人在进行侵权活动或即将进行侵权活动,却仍然允许在其场地上发生,那么就应当承担责任。”
在Fonovisa v. Cherry Auction案(1996) 中,联邦第九巡回上诉法院同意Hard Rock Café案中适用于场地出租人的商标辅助侵权原则,并结合案情做出了详细论述 。
该案被告Cherry Auction是一家跳蚤市场的经营者,主要将店面出租给个体商贩来赚取日常租金。此外,被告还向顾客提供有偿停车场服务,每位顾客进入其市场都需要交纳一定的门票费。被告对其跳蚤市场做过市场宣传,在与租户的合约中保留了在任何时候、以任何理由将租户赶出其跳蚤市场的权利。因此,被告有权以租户从事侵犯专利权或商标权的活动为由将租户驱逐出市场。
法院查明,被告知道其市场内的租户销售侵犯原告拥有版权和商标权的音像制品。1991年,Fresno县的有关部门曾对被告的跳蚤市场进行过突击搜查,查获了38,000多张盗版音像制品。1992年,在发现被告市场内的租户仍然在销售盗版音像制品后,该县治安官致函给被告,提醒其曾同意向治安官提供租户的个人识别信息。此外,1993年,原告自己曾派调查员赴被告市场,发现确有侵权音像制品在销售。
法院认为,被告出租的是一间间的店铺,还派人在市场内巡视。被告有能力通过终止与租户的合约的这种手段来制止其场地上租户的侵权活动。此外,被告还对该跳蚤市场做过市场宣传,能够对顾客进入跳蚤市场加以控制,实际上,被告也从购买侵权音像制品的顾客那里获取了实质性的经济收益。很显然,被告在明知他人在其场地上从事侵权活动的情况下,却仍然提供必要场地的行为构成了商标的辅助侵权。
从以上案例可以看出,美国法院在认定场地出租人的商标侵权责任时,主要、考虑两个标准。一是主观上要求“明知”,即场地出租人知道或应当知道他人在其场地上进行侵权活动;二是客观上要求不作为,即场地出租人有能力对租户的侵权行为加以控制或制止但却没有采取行动。至于场地出租人是否从直接侵权人的侵权活动中得到经济利益,笔者认为意义不大。现有判例也表明法院可以通过对场地出租人的经济收益做扩大解释来建立与侵权活动之间的因果关系。况且,是否从侵权活动中取得收益只是计算赔偿额时考虑的因素,而并非判断是否构成侵权的要件。
(五)本案中的被告是否构成商标侵权
从前文所述可知,美国法院对场地出租人承担商标侵权责任的态度与我国商标法实施条例第五十条第一款第(二)项规定的精神在本质上是相同的,即两方面的要求。一是主观心理态度,“明知”和“故意”虽然措辞不同,但意思有相同之处,这可以归结为主观上具有过错;二是客观上要求为他人侵权提供便利,“明知”他人侵权而“视而不见”,任由侵权活动在自己提供的场地内继续发生,在客观上也等于为他人的侵权活动提供了便利。因此,笔者认为,商标法实施条例第五十条(二)中的“等便利条件”不是穷尽性的规定,也包括“仓储、运输、邮寄、隐匿”外的便利行为。
首先,场地出租人主观上是否构成故意需要根据个案情况而定。如果客观情况表明场地出租人应当知道他人在其场地内从事侵权活动,仍然不采取合理措施来控制直接侵权人的侵权行为,那么就可以推定场地出租人主观上存在“故意”。比如,有关行政执法机关或司法机关在场地出租人管理的场地中发现有租户从事侵犯他人商标权的非法活动,后来又通知了场地出租人或场地出租人以其他方式知晓,那么就应该推定场地出租人“意识到”在其管理的场地上有侵权活动的发生。如果能证明在执法检查时场地出租人(包括其雇员)向从事侵权活动的租户通风报信,更是证明场地出租人存在主观“故意”的心理。
但是,如果商标权人事先没有借助行政执法或法院程序,而是自行调查发现场地出租人管理的场地内有租户在销售侵犯其商标专用权的商品,由此向场地出租人发出律师函或以其他方式通知要求场地出租人采取行动,那么能否推定场地出租人“明知”侵权活动的存在?笔者认为应视具体情况而定。
商标权人发出的律师函代表的是个体观点,不具有行政处罚或司法裁判那样的公信力,其主张的事实是否属实有待进一步核实,否则将会导致权利的滥用。商标权人的律师函或其他文件至少应包括以下事项:能够证明商标权人拥有相关商标权的证据(如注册商标证或书面的授权许可使用协议);商标权人姓名/名称/地址或联系方式;场地内涉嫌销售假冒商品的租户姓名或店铺名;店铺的具体位置;侵权商品的种类,这些是使场地出租人进行调查的必要信息。虽然场地出租人没有法定义务对其场地内租户销售的商品是否有合法来源主动调查,但接到商标权人的律师函后,如果能获知足够的信息进行形式调查,那么就应该有所行动。如果调查发现,涉嫌租户能够证明其系经过商标权人的授权而销售商品(如出具授权书或相关合同),或者能够证明商标权人主张的商标权正处于不稳定状态(比如正在行政异议或司法审查程序中),那么场地出租人应将此情况及时反馈给商标权人,作为单纯租赁场地提供者应尽的义务就应算履行完毕。如果商标权人对反馈结果持异议,可以借助行政或司法程序来认定是否侵权。当然,如果涉嫌租户不能证明其系经合法授权而销售涉嫌商品,那么场地出租人就可以推定商标权人的主张成立,从而采取合理的行动来制止直接侵权人的进一步侵权行为。
其次,如果推定场地出租人已经“明知”到侵权活动的存在,那么是否一定要求场地出租人终止与实施侵权活动的租户的租赁合同,将其赶出自己的场地呢?笔者认为,这要看场地出租人是否能依合同约定获得此种权利。如果合同约定了场地出租人在租户从事非法活动时有权终止合同的 ,那么在客观情况足以证明租户销售侵犯他人商标权商品时,场地出租人就应当终止与该租户的合同,这样才能避免继续为侵权者提供便利条件的嫌疑。但如果租赁合同中没有这类授权条款,场地出租人便无权因租户销售的商品侵犯了他人商标权而终止合同,否则就承担违约的风险 。
笔者认为,在上述第二种情况下,场地出租人只能采取其它措施,比如监控侵权租户的销售活动,发现其继续销售侵犯他人商标权商品时,及时报告给商标权人或有关部门以履行注意义务。在这种情况下,客观上场地出租人继续为侵权租户提供场地,但在主观上场地出租人缺乏为他人提供便利的故意,客观行为和主观方面冲突,因此,场地出租人不够成侵权。
综上所述,本案被告是否构成商标侵权要从两个方面判断。一是主观上是否是“明知”或“故意”,二是客观上是否为租户侵权提供便利,二者缺一不可。
(六)责任的分担
如果依商标法实施条例五十条(二)项认定场地出租人构成商标侵权,那么其与直接侵权的租户之间应如何分担法律责任?笔者认为,两者的侵权行为属于共同侵权,需要承担连带责任。场地出租人“明知”侵权租户的行为而为其提供场地上的便利使得两者主观上具备共同侵犯他人商标权的故意。当然,在确定各共同加害人各自的份额时,仍应当视共同行为人各自的主观过错程度和行为的原因力来综合判断。场地出租人与租户之间的租赁合同中如果有免除或减轻场地出租人责任的条款,对外不产生法律效力。
(七)结语
当今假冒商品的侵权活动愈演愈烈,原因之一就是因为假冒商品的零售商是零散的个体商贩,因此单纯打击这些散兵游勇并非明智之举。能够对侵权网络进行釜底抽薪式打击的方法就是端掉零售者的场所,让他们无处藏身,这就需要场地出租人为场地承租者的商标侵权行为承担责任。国外的案例已经充分表明了商标权人的这一诉讼策略。
在知识产权保护国际一体化的过程中,国外权利人对我国知识产权保护提出了越来越高的要求,因此,新秀水市场案的发生带有一定的必然性。由于我国法律对场地出租人的侵权责任还没有比较明确规定,司法裁判的空间存在很大的未知数。可以说,该案具有“投石问路”的作用,一旦权利人的诉讼主张获得司法支持,将会给我国场地租赁经营行业带来一场巨大的震动。

北京市农业植物检疫实施办法
市农业局


第一条 为防止为害农业植物的危险性病、虫、杂草传播,保护农业生产安全,根据国务院发布的《植物检疫条例》《以下简称《条例》)和农牧渔业部制定的《植物检疫条例实施细则(农业部分)》(以下简称《细则》),结合本市情况,制定本办法。
第二条 本市行政区域内农业植物检疫(以下简称植物检疫),必行全面执行《条例》、《细则》和本办法。
第三条 市农业局主管全市农业植物检疫工作,其执行机构是市植物保护站。各县(区)农业局主管本县(区)农业植物检疫工作,其执行机构是所属的植物保护站。
市、县(区)植物保护站设植物检疫员,由市农业局根据《细则》规定的条件审查批准,报农牧渔业部备案后,发给《植物检疫员证书》。
第四条 本市各级植物保护站依据下列植物检疫对象名单施行检疫和签发检疫证书:
(一)农牧渔业部制定的《农业植物检疫对象和应施检疫的植物、植物产品名单》;
(二)市农业局制定的《农业植物检疫对象和应施检疫的植物产品名单》;
(三)其它省、自治区、直辖市制定的《农业植物检疫对象和应施检疫的植物、植物产品补充名单》;
(四)植物调入省、自治区、直辖市检疫机构提出植物检疫要求文件。
第五条 局部地区发生检疫对象的,应将该局部地区划为疫区。疫区内的农业生产经营单位或个人,必须按植物保护站的要求,采取有效的封锁和控制措施,防止检疫对象传出。
在较大范围内普遍发生检疫对象时,应将该范围内未发生检疫对象的局部地区划为保护区,采取保护措施,防止检疫对象传入。
疫区和保护区的划定、变更和撒销,由市农业局报市人民政府批准,并报农牧渔业部备案。
第六条 市、县(区)植物保护站对新传入的检疫对象和其他危险性病、虫、杂草,应及时查清情况,采取有效的封锁和控制措施,并报告同级人民政府和上级农业主管部门。
第七条 原种场、良种场等农业植物种、苗繁育单位,应在无检疫对象地区建立种、苗繁育基地。种、苗繁育基地的农业植物产品,由市、县(区)农业植物保护站进行产地检疫。经产地检疫合格的,可以在本市、县(区)之间调运;需调出本市的,应申领《植物检疫证书》。
未取得产地检疫合格证的农业植物种子、苗木及其繁育材料,不得出售、转让、调运或刊登广告。
第八条 本市调出农业植物种子、苗木及繁殖材料的单位和个人,必须在调出前7日内,凭调入省、自治区、直辖市农业植物检疫部门的检疫要求文件,向市植物保护站及其授权的县(区)植物保护站报检,经检疫合格并签发《植物检疫证书》后,方准调出本市。
第九条 凡本市单位和个人需从外省、自治区、直辖市调入农业植物种子、苗木及其繁殖材料的,必须事先向市植物保护站及其授权的县(区)植物保护站提出检疫申请,由市植物保护站向调入单位或个人提出检疫要求,经调出单位或个人所在省、自治区、直辖市植物检疫部门按本市

的植物检疫要求文件检疫合格,签发《植物检疫证书》后,方可调入本市。
第十条 市、县(区)植物保护站对调入本市的农业植物、农产品,司以进行复检,发现带有检疫对象的,应按《条例》和有关规定,与调出省、自治区、直辖市协商解决。调入单位或个人应按市、县(区)植物保护站的要求处理,并对运输工具、包装物、存放场地以及其他司能附着
检疫对象的物品进行除害处理。
第十一条 铁路、公路、航空等运输管理部门和邮政部门,凭本市植物检疫机构签发的、有效期内的植物检疫证书,承办农业植物、农产品的运输或邮寄。
第十二条 本市各单位和个人,从国外引进农业植物种苗及繁殖材料的,必须经归口的主管单位同意后,由市植物保护站办理检疫审批手续。
引进的种子,必须集中隔离试种。隔离试种应符合下列条件:
(一)引进种、苗不得直接试种于当地同类作物的集中种植带;
(二)不得直接把引进材料引入良种繁育体系;
(三)集中种植,定期观察,及时处理。
进口原粮一律不得作为种子。
第十三条 在隔离试种期内,由市、区(县)植物保护站负责检疫。经试种观察未发现检疫对象的,准予分散种植;对带有检疫对象或其他危险性病、虫、杂草的,由引种单位按植物保护站的要求及时处理。
第十四条 凡在本市举办国际、国内各种形式的农业植物展览会、展销会、科技交流会等活动的主办单位,应事先报请市植物保护站,依法实施检疫。
第十五条 接受农业植物检疫的单位和个人,应按规定交纳检疫费,检疫过程中的除害处理费用以及除害所造成的经济损失,均由接受检疫的单位和个人承担。
经市农业局、市粮食局批准调运的粮、棉、油等救灾备荒的种子,免收检疫费。
第十六条 对违反《条例》、《细则》和本办法有关规定的单位和个人,由市、区(县)植物保护站依照下列规定予以处罚:
(一)对涂改植物检疫证书的,处30元至50元罚款;
(二)对伪造、诓骗植物检疫证书的予以通报,并对违法个人处以100元至200元罚款,对违法单位处以500元至1000元罚款;
(三)对未取得《植物检疫证书》,违法调运农业植物、植物产品进京的单位和个人,除依照本办法补办检疫手续外,对违法个人并处50元至100元罚款,对违法单位并处1000元至5000元罚款。造成检疫对象扩散的,必须赔偿经济损失;
(四)未经市植物保护站审查批准,违法从国外引入农业植物种、苗的,或者将未经隔离试种的种、苗转让、赠送和销售分散种植的,除应依法补办手续外,对违法的个人处3元至30元的罚款,情节严重的处100元至200元罚款;对违法单位处500元至1000元的罚款;造
成检疫对象扩散等严重后果的,处1000元至5000元的罚款,并赔偿经济损失。
第十七条 植物检疫人员徇私舞弊,玩忽职守,滥用职权,情节较轻的,给予行政处分,构成犯罪的,依法追究刑事责任。
对拒绝、阻碍植物检疫人员依法执行职务的,由公安机关依法给予治安管理处罚;构成犯罪的,依法追究刑事责任。
第十八条 本办法具体应用中的问题,由市农业局负责解释。
第十九条 本办法经市人民政府批准,自1987年9月1日起施行。1975年3月10日原北京市革命委员会转发的《北京市植物检疫试行办法》同时废止。
